These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and Max Options Trading Cards LLC, a Florida limited liability company doing business as Max Options Trading Cards and MOT Cards ("MOT," "we," "us," or "our"). They govern your access to and use of maxoptionstradingcards.com, our applications, and all related services (together, the "Services").
By creating an account or using the Services you accept these Terms, our Privacy Policy, and any policies we link from the Services. If you do not agree, do not use the Services.
Please read Section 18 (Dispute Resolution). It requires individual arbitration, waives jury trials and class actions, and gives you 30 days to opt out.
1. What MOT Cards is
MOT Cards is a digital pack-opening platform backed by real, professionally graded trading cards held in custody at PSA Vault. When you buy and open a pack, you receive one card from that pack's disclosed card pool, selected at random according to the odds published on the pack page. You then choose to keep the card in your MOT collection, sell it back to us for wallet credit, or transfer it to your own PSA Vault account.
You are purchasing the right to receive one card from the disclosed pool at the published odds — not any particular card, grade, or market value. Every pack contains a real card with real market value; there is no "losing" pack.
MOT does not ship physical cards. Cards stay in PSA Vault custody until you transfer them to your own PSA Vault account (Section 6).
Nature of the product. Each pack is a purchase of a collectible good. You always receive a real, professionally graded trading card with real market value; the only variable is which card from the disclosed pool you receive. Packs are not a lottery, sweepstakes, raffle, wager, or game of chance: there is no "prize," no possibility of receiving nothing, and no entry fee separate from the purchase price. Sell-back is an optional, separate transaction in which we offer to repurchase a card you already own. To the fullest extent permitted by law, you waive any claim under any gambling-loss-recovery or similar statute arising from your purchases.
Responsible purchasing. Packs are for personal collecting and entertainment. Set a budget and stick to it; do not buy packs with money you need for essentials, and do not chase a particular card. If you would like us to pause purchases on your account for a period of time or permanently, email support@maxoptionstrading.com with "Self-exclusion" in the subject and we will apply it within 2 business days. You can still withdraw eligible balances and transfer cards while excluded.
2. Eligibility
To use the Services you must:
- be at least 18 years old (or the age of majority where you live, if higher);
- be a natural person acting for your own personal collecting and entertainment, not for commercial purposes;
- be a resident of the United States;
- hold only one account, in your own legal name, funded with payment methods that belong to you;
- not be on any U.S. sanctions list and not have been previously removed from the Services.
You are responsible for knowing whether use of the Services is lawful where you are located. We may limit or refuse access from any location, at any time, at our discretion, and we may require proof of age, identity, or location before you can purchase, sell back, transfer, or withdraw.
3. Your account
You are responsible for everything that happens under your account, whether or not you authorized it, unless caused by our breach of these Terms. Keep your password confidential, do not share your account, and tell us immediately at support@maxoptionstrading.com if you suspect unauthorized use.
Multiple accounts, account sharing, account transfers, false registration details, automated access, VPN or proxy use to mask location, and exploiting bugs or promotions are grounds for immediate suspension or termination and forfeiture of promotional balances.
You may close your account at any time from account settings or by contacting support. Before closing, withdraw any eligible wallet balance and transfer or sell back any cards in your collection; we may treat cards and balances left in a closed account as abandoned where permitted by law.
Inactive accounts. Your account is inactive if you do not log in for 365 consecutive days. We will send inactivity warnings to your registered email after 90, 180, and 360 days without a login; the 360-day notice will also ask for the information we need to reimburse you. Logging in at any time resets the clock. If your account reaches 365 days of inactivity, we may reclaim the cards remaining in your collection and credit your wallet 50% of each card's then-current Card Ladder value; the resulting balance remains withdrawable under Section 8, where permitted by law. If unclaimed-property law in your state requires different treatment, we follow that law.
4. Packs, odds, and randomness
- Published odds. Each pack page discloses the outcome tiers, the probability of each tier, and the card pool. Each opening is an independent random draw: one draw at the published per-tier probabilities, then a uniform random selection among the eligible cards in that tier.
- Inventory changes odds. Card pools and the cards eligible in each tier change in real time as cards are pulled, sold back, and restocked. A pack is shown as sold out if any disclosed tier has no inventory.
- Statistics, not guarantees. Odds and expected values are statistical averages across many openings, not a promise about any single pack.
- Animations are presentation. Reveal animations, sounds, and effects are entertainment only. The outcome is determined when the opening is processed, before any animation plays.
- Errors. If an opening is affected by a pricing, odds, inventory, or software error, we may void the opening and refund the pack price to your wallet balance.
5. After you open a pack: keep, sell back, or transfer
Sell-back offer at opening. When your card is revealed we show a sell-back offer, fixed at that moment, of 90% of the card's Fair Market Value ("FMV"). A selling fee of 3.5% of the offer is deducted from every sell-back; the offer, the fee, and the net amount credited are itemized on the confirmation screen before you accept. This offer is valid for 24 hours from opening. Accepting it credits your wallet instantly and returns the card to our inventory. Sell-backs are final.
Keep. If you do nothing, or choose to keep, the card simply stays in your collection. Nothing happens automatically when the 24-hour offer expires.
Sell back later. Cards in your collection may be sold back to us after the 24-hour window at 85% of then-current FMV, less the 3.5% selling fee, during our daily sell-back window of 8:00 AM to 11:00 AM Eastern Time. The offer shown in-app at the time of sale controls. We may pause or change later sell-back availability, pricing, or hours at any time with notice in the Services; any offer you have already accepted is honored.
Transfer to PSA Vault. See Section 6.
6. PSA Vault transfers and custody
- Every card in your collection is a specific, serial-numbered graded card held at PSA Vault. While it is in your MOT collection, MOT is the PSA Vault account holder and holds the card for you.
- You may request a transfer of any card in your collection to your own PSA Vault account at any time. A transfer fee of $3.00 per card is charged to your wallet when the transfer is submitted; the fee is refunded if the transfer fails. You verify the email address on your PSA Vault account once from your profile page; transfers are then submitted to PSA for that verified address. If no PSA Vault account exists for that email, PSA may create one.
- Once PSA confirms the transfer, the card leaves your MOT collection and can no longer be sold back to MOT. Any further storage, shipping, grading, or sale of the card is between you and PSA under PSA's terms and fees. MOT does not ship cards and is not responsible for PSA's services.
- If a card in your collection is lost, damaged, or becomes unavailable while in custody, your sole remedy is a wallet credit equal to the card's FMV at the time we become aware of the loss.
7. Fair Market Value
FMV is our good-faith estimate of a card's current market value, derived from third-party market data (currently Card Ladder) and our internal pricing rules. FMV is used for sell-back offers, odds tiers, collection values, and loss credits. FMV is an estimate, not a guarantee of what you could obtain elsewhere, and it can change at any time. You accept the risk that a card's value may move between opening and any later sell-back or transfer.
8. Wallet, deposits, and withdrawals
- Your MOT Wallet is a U.S.-dollar-denominated balance in your MOT account used to buy packs. It is not a bank account, is not insured, earns no interest, and cannot be transferred to another user.
- Deposits are made through Stripe. Deposited funds are intended to be spent on the Services. Deposits are non-refundable except as described in Section 9, and deposits that have not been used on the Services are not eligible for withdrawal; only proceeds from sell-backs and refund credits are withdrawable.
- Withdrawals are paid through Stripe Connect to a bank account or debit card in your name. The minimum withdrawal is $1.00, and you may request at most one withdrawal per 24-hour period. Withdrawals under $200.00 carry a 3.5% withdrawal fee, deducted from the amount paid out and shown before you confirm; withdrawals of $200.00 or more carry no MOT fee. Before your first withdrawal (and at any later time), you must complete Stripe's identity verification, and we may require additional identity, age, or source-of-funds checks. Withdrawal requests are reviewed and approved manually; most are released within 14 business days of approval. Third-party payout fees, if any, are shown before you confirm. Once a payout is sent it cannot be reversed; you are responsible for entering correct payout details.
- Holds. We may hold, delay, or cancel any withdrawal while we investigate suspected fraud, chargebacks, account sharing, or violations of these Terms, or as required by law.
- Promotional credit, if we offer any, is not withdrawable, may expire, and may be canceled at any time.
9. Payments, refunds, and chargebacks
- Prices are in U.S. dollars. No sales tax is charged because no goods are shipped by MOT; you are responsible for any taxes that apply to you, and we may request tax information (for example, a Form W-9) before paying out amounts that may require reporting.
- All pack purchases, sell-backs, and deposits are final. We refund only where (a) you were charged twice or a confirmed technical or payment error occurred, (b) a charge was unauthorized after our review, (c) we cancel or cannot fulfill a purchase, or (d) the law requires it. Refunds go to your wallet or your original payment method, at our discretion. Refund requests must be sent to support@maxoptionstrading.com within 24 hours of the transaction.
- We do not refund because you are unhappy with a card, its grade, its value, or the outcome of a random draw.
- Chargebacks. If you dispute a charge with your bank instead of contacting us, we may suspend your account, reverse any cards, credits, or payouts tied to the disputed funds, and the disputed amount becomes a debt you owe us.
10. Promotions and sweepstakes
From time to time we may run giveaways, sweepstakes, contests, referral programs, or other promotions. Each promotion is governed by its own Official Rules, which we will post with the promotion and which control over these Terms if they conflict. Sweepstakes are free to enter; no purchase is necessary and a purchase does not improve your chances of winning. A free alternative method of entry will always be described in the Official Rules. Promotions are void where prohibited, open only to eligible users under Section 2, and limited to one entry per person unless the Official Rules say otherwise. We may modify, suspend, or cancel any promotion at any time, and may disqualify entries or withhold prizes for fraud, multiple accounts, automation, or violations of these Terms. Prizes are awarded as described in the Official Rules and may be subject to tax reporting.
11. Prohibited conduct
You agree not to: interfere with or disrupt the Services; access non-public systems or data; use bots, scripts, or automation; scrape content; reverse engineer the Services; abuse inventory, odds, promotions, or referral programs; collude with others to exploit the Services; use the Services to launder money or evade sanctions; harass other users or our staff; impersonate anyone; post unlawful, infringing, or abusive content; or violate any law.
We may investigate, suspend, or terminate any account we reasonably believe has violated these Terms, and may withhold or reverse balances and cards to the extent needed to undo the benefit of a violation, comply with law, or compensate affected users or MOT.
12. Intellectual property and license
The Services, including software, designs, animations, text, branding, and data, are owned by MOT or our licensors. We grant you a limited, personal, non-transferable, revocable license to use the Services for personal entertainment in accordance with these Terms. Card images, player names, team names, and set names belong to their respective owners and are used for identification only.
If you post content to the Services (for example, a username or profile image), you grant us a worldwide, royalty-free license to use it to operate and promote the Services. Feedback you send us may be used without obligation.
13. Copyright complaints
If you believe content on the Services infringes your copyright, send a notice to legal@maxoptionstrading.com with: your signature; identification of the work; the location of the infringing material; your contact details; a statement of good-faith belief; and a statement under penalty of perjury that the notice is accurate and you are authorized to act.
14. Third-party services
The Services rely on third parties, including Stripe (payments and payouts), PSA Vault (custody and transfers), and Card Ladder (market data). Your use of those services is subject to their terms. We are not responsible for third-party services, and their availability may affect ours.
15. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure; that any card will have or retain any value; that any grade, condition, or third-party assessment is accurate; or that FMV matches any price available elsewhere. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, MOT and its officers, directors, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from the Services or these Terms. Our total liability for all claims will not exceed the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the claim and (b) USD $100. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence or for fraud.
17. Indemnity
You will defend, indemnify, and hold harmless MOT and its affiliates from claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your content, your violation of these Terms, or your violation of law or third-party rights.
18. Dispute resolution: arbitration and class waiver
- Informal resolution first. Before starting arbitration or any court action, email legal@maxoptionstrading.com with your name, account email, a description of the dispute, and the relief you want. We will try to resolve it with you for 60 days.
- Binding arbitration. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration will take place in Palm Beach County, Florida, or by video or phone, or on documents only, at your election for claims under $25,000. We will pay all AAA filing, administrative, and arbitrator fees above $225, except where the arbitrator finds your claim frivolous.
- Class action and jury waiver. You and MOT agree that claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding, and that both of us waive any right to a jury trial. The arbitrator may not consolidate claims of more than one person.
- Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief in court to protect intellectual property.
- Remedies in arbitration. The arbitrator may award any individual relief a court could, but may not award punitive, exemplary, incidental, indirect, or consequential damages (including lost profits), and must apply the limitations in Section 16. The arbitrator will issue a reasoned written decision. The arbitration and its outcome are confidential except as needed to enforce an award or as required by law.
- Coordinated claims. If 20 or more similar arbitration demands are filed by or with the assistance of the same or coordinated counsel within 90 days, they will be administered in batches: an initial batch of up to 25 claims proceeds first before a single arbitrator with a single set of fees; the parties then mediate all remaining claims; any claims still unresolved proceed in further batches of up to 100. Filing and arbitrator fees are assessed per batch, not per claim. Statutes of limitation are tolled for claims awaiting a batch. A batch is not a class or collective proceeding, and each claim is decided on its own facts.
- 30-day opt-out. You may opt out of this arbitration agreement by emailing legal@maxoptionstrading.com with the subject "Arbitration Opt-Out," your name, and your account email within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
- Courts. If a dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.
- Governing law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where consumer protection law in your state of residence requires otherwise.
- Time limit. Any claim must be filed within one year after it arises, unless a longer period is required by law.
19. Changes to the Services and these Terms
We may change, suspend, or discontinue any part of the Services at any time. We may update these Terms by posting a new version with a new effective date; material changes will also be announced in the Services or by email. Continued use after the effective date is acceptance of the new Terms. If we materially change Section 18, you may reject that change by emailing us within 30 days, in which case the prior version of Section 18 applies to you.
20. General
These Terms and the policies they reference are the entire agreement between you and MOT about the Services. If any provision is unenforceable it will be modified to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events outside our reasonable control. Sections 5 through 10 and 12 through 20 survive termination. You consent to receive notices and disclosures from us electronically.
